TERMS & CONDITONS WELTREISE-TRAUM
CONTRACT
Your contract will be with WELTREISE-TRAUM eGbR, (WELTREISE-TRAUM) a company registered in Germany (company VAT registration number DE299037677) and will be subject to German law at all times.
RESERVATION & PAYMENT
An advance payment of 20% of all services per person is required to effect land and or airline reservations and to secure reservations more then 90 days prior to departure. This must be received within three days of booking to secure a reservation. A second payment of 60% must be received 4 weeks after booking. The remaining 20% is required 4 weeks prior to departure. Special payment policies may apply and will be advised at time of reservation. If payment is not received by the due date, airline, hotels and all other reservations will be cancelled and deposits shall be forfeited. WELTREISE-TRAUM is not responsible for any penalties, fare increases or fees incurred due to late payment. Submission of payment to WELTREISE-TRAUM signifies the acceptance of the Terms & Conditions of Sale.
As a result of a cancellation, WELTREISE-TRAUM and third party supplier’s cancellation penalties will apply, which are detailed in your travel documentation, these Terms and Conditions, the website (www.worldtravel-dream.com), and third party suppliers’ websites. All cancellation fees will be charged to the customer to pay for travel services, including cancellation fees, or deducted from the suppliers' refund(s).
Airline tickets and documents will be sent approximately four (4) weeks prior to customer’s departure. Note: Airline reservations will not be ticketed without a copy of the appropriate pages of the traveler’s passport.
PAYMENT
Payment may be made by wire transfer. We suggest you check with your bank to see if they charge any foreign transaction fees. The transfer costs are to be paid by the customer.
WELTREISE-TRAUM accepts credit cards from Visa or MasterCard but with an additional surcharge of 3.5 %.
RATES
Prices shown are based on tariffs, exchange rates, and airfares in effect as indicated by each travel offering. WELTREISE-TRAUM reserves the right to alter prices quoted should inflation, costs of fuel, labor or material, airfares or foreign exchange rates change. Non-discountable fees such as (but not limited to) port charges are included in pricing unless otherwise stated. Airfare, air taxes, fuel surcharges, transfers, government fees, and taxes are additional unless otherwise stated. Information and pricing are subject to change without notice. In the event of a pricing error, or any omission, WELTREISE-TRAUM reserves the right to adjust the pricing or make any other corrections. Every attempt has been made to include all taxes. In rare instances, certain entry fees and departure taxes must be paid in cash only upon entry and departure from a country, and may vary in price. Travel suppliers may add a fuel surcharge, and Customer agrees to pay it.
All rates are quoted in EURO unless otherwise noted. Rates are subject to change at any time, without notice. WELTREISE-TRAUM reserves the right to make adjustments if a particular rate was incorrectly stated. WELTREISE-TRAUM can guarantee air rates only for reservations paid in full. Government and supplier-imposed taxes and fees are subject to increase at any time and are not covered by WELTREISE-TRAUM. Rates do not include Airline baggage or seat assignment fees or other ancillary fees, passport and visa fees, some departure taxes, gratuities, meals, beverages, insurance, telephone calls, additional bedding charges, laundry service, and other miscellaneous charges of a personal nature are not included except where specifically noted.
NOT INCLUDED IN TOUR COSTS
Following are examples of charges and fees not included in the tour cost: fees for obtaining passports or visas, excess baggage charges, immunizations, insurance, international airline ticket taxes, airport (or other) entry fees and departure taxes, parking fees, optional tours, any items of a personal nature (such as phone calls, faxes, or room service), excess mileage carried out at the request of the passenger, and/or transportation not specifically listed as included. Beverages (liquor and soft drinks) and laundry are included at select properties and will be specified.
CHANGE OF SERVICES AND PRICES
PRE-DEPARTURE CHANGES BY WELTREISE-TRAUM
It is occasionally necessary for us to make changes to the individually designed trips. Most of these are minor changes and if we know in advance, we will notify you as soon as possible. Minor changes include change of airline or type of aircraft, flight timings of 12 hours or less and a change to accommodation of a similar standard.
It may be necessary to make a major change to your vacation such as offering hotels of a lower standard or a change of destination. In this case, we will do our best to offer you a suitable alternative, with a price refund if appropriate or allow you to change to an alternative vacation. Some tours may require a minimum number of participants and if that number is not reached, the tour may have to be cancelled or amended. If you are not happy with the alternative offered, we will gladly offer a refund. If the customer decides in favor of a higher-quality tour or higher-quality accommodation or services of a different kind, WELTREISE-TRAUM is entitled to charge the additional costs incurred to the customer.
CHANGES AFTER DEPARTURE
No refunds will be granted on unused services once travel has commenced. WELTREISE-TRAUM, will assess a $100 per person fee for changes made after commencement of travel. Changes in return transportation to the extent permitted by carrier(s)’ tariff may be made only through WELTREISE-TRAUM ’s representatives. Changes in travel arrangements that result in additional monies owed due to price differences, fuel surcharges, ticket re-issuance fees, etc. are due and payable directly to WELTREISE-TRAUM ’s representatives at time of change.
ALTERATIONS TO TOURS IN GENERAL
If between planning time and/or during actual travel circumstances require changes, WELTREISE-TRAUM and its suppliers of travel services reserve the right to cancel or vary any itinerary and substitute components of any tour, including (but not limited to) hotels and camps of comparable quality, if air schedule or surface transportation charges, security matters, and/or events make such alterations necessary. Suppliers may substitute transportation equipment depending on any variety of factors, including the volume of passengers on the tour. Additionally, WELTREISE-TRAUM reserves the right to pass on to Customer(s) any expenditure occasioned by delays or events beyond its control. In case of any appreciable variation in its cost, WELTREISE-TRAUM reserves the right to adjust its rates.
CANCELLATION
WELTREISE-TRAUM will assess a fee for cancellations. This fee depends on the date when we receive notification of your request to cancel your reservation:
WELTREISE-TRAUM demands for
more then 40 days prior to departure 40 % of the total travel costs
40 days to 31 days prior to departure 50 % of the total travel costs
30 days to 15 days prior to departure 60 % of the total travel costs
14 days to 8 days prior to departure 70 % of the total travel costs
7 days to 4 days prior to departure 75 % of the total travel costs
3. days or less prior to departure or no shows 80 % of the total travel costs
as a claim for compensation.
If final and full payment is not received by the applicable due date, reservations are subject to
cancellation and deposits shall be forfeited. WELTREISE-TRAUM reserves the right to treat the booking
as cancelled if the balance due is not paid when due.
If you have a policy of insurance you may find that a refund of your losses may be possible.
Once travel has begun, there will be no refunds for any unused or partially used travel component for any reason.
While every effort will be made to provide all items on the travel itinerary as booked, WELTREISE-TRAUM reserves the right to cancel or alter any reservation for any reason prior to departure. Should this occur, refunds will be made without any further obligation by WELTREISE-TRAUM.
With respect to the travel arrangements made in connection with this transaction, WELTREISE-TRAUM, represents and acts as agent for disclosed principals and independent contractors, including carriers, transportation companies, tour operators, wholesalers, service companies, hotels, etc. WELTREISE-TRAUM, is not responsible or liable for any acts, omissions, financial stability, delays or changes by any of these entities. Neither WELTREISE-TRAUM nor any of its representatives shall be or become liable or responsible for any loss, injury, damage to person, property, or otherwise in connection with any accommodations, transportation or other services resulting directly or indirectly from any extraordinary circumstances, including but not limited to acts of God, dangers incident to the sea, natural disasters, breakdown in machinery, acts of governments, de jure or de facto, war, hostilities, civil disturbances, strikes, riots, thefts, epidemics, medical quarantines, customs regulations, defaults, delays or cancellations of or changes in itinerary, routing or schedules from any cause beyond the control of the WELTREISE-TRAUM, or from any loss or damage resulting from insufficient or improperly issued passports, visas or other documents.
AIR TRANSPORTATION
WELTREISE-TRAUM has no control over and assumes no liability for airline strikes, schedule changes, flight delays, flight cancellations or other airline initiated changes. In the event of such an occurrence, the airline is responsible and will determine what action will be taken.
ACCOMMODATIONS
Facilities, guest services and amenities are provided at the discretion of the hotel and are subject to change without notice. Any additional costs are the responsibility of the customer and are payable directly to the hotel. Room location, connecting rooms and bedding requests are not guaranteed and are based upon availability at time of check in. Hotel descriptions and photos do not necessarily depict the actual room in which guests will be accommodated; maps and images may not be exact or to scale, and are for general description purposes only. Room standards are the sole responsibility of the hotel. Hotel ratings are based on information provided by the hotel and WELTREISE-TRAUM ’s own evaluations.
BAGGAGE AND PERSONAL PROPERTY
Baggage checked or carried on board an aircraft or vehicle are subject to fees based on weight, number and size. All baggage fees are the responsibility of the customer and are payable directly to the supplier (unless otherwise agreed). Please contact the supplier for their current baggage policy. WELTREISE-TRAUM is not responsible or liable for any delay, loss or damage to baggage and personal property.
PHYSICAL DISABILITIES
Customers requiring special facilities, services or accommodations must disclose such needs to WELTREISE-TRAUM at time of reservation. Wheelchair- accessible transportation and accommodations may be requested, but cannot be guaranteed. Available accommodation standards vary by hotel and are not within the control of WELTREISE-TRAUM. WELTREISE-TRAUM assumes no liability for the failure for the provision of accommodations by a travel vendor.
RESPONSIBILITY
WELTREISE-TRAUM is not the source or supplier of the travel services requested, and acts solely as an agent for disclosed principal supplier airlines, hotels, cruise lines, safari camps, air charters, bus companies, ground transportation, boat purveyors or owners, and other independent contractors providing accommodations, transportation, and/or other services. Each of these companies is an independent entity with its own management, and is not subject to the control of WELTREISE-TRAUM. Customer is advised that the suppliers whose names appear in travel documentation are those actually responsible for providing the travel services purchased, and consents to the use of those suppliers, and understands and agrees each supplier’s terms and conditions are contained in printed form and/or on their respective web sites governing the transaction. All bookings are accepted by WELTREISE-TRAUM as agent for independent third party travel suppliers in your itinerary. Transportation, accommodations and other services provided by the identified sea, air and operators offered are subject to the terms and conditions contained in the tickets, exchange orders or vouchers issued by them and/or their suppliers, including terms and conditions on their respective web sites.
Because WELTREISE-TRAUM acts as a agent for disclosed principal suppliers and does not have the right to control the operations of such independent operators and suppliers, you agree, WELTREISE-TRAUM is not liable for any personal injury or property damage which may arise out of these services. WELTREISE-TRAUM hereby disclaims any liability whether based on contract, tort, strict liability or otherwise, including without limitation liability for any direct, punitive, special consequential, incidental or indirect damages, in connection with the goods or services provided by any principal supplier booking through WELTREISE-TRAUM’s office through this web site, including without limitation liability for any act, error, omission, injury, loss, accident, delay or irregularity which may be incurred through the fault, negligence, willful acts, omissions or otherwise of such supplier, or of any supplier or their respective employees, agents, servants, or representatives, including, without limitation, their failure to deliver or their partial or inadequate delivery of services, fuel increases, and other matters outside of WELTREISE-TRAUM’s control, and you hereby exonerate WELTREISE-TRAUM from any liability with respect to the same.
WELTREISE-TRAUM shall not be liable for any accident, injury, property damage, or personal loss to customer or to those traveling with customer in connection with any accommodations, transportation, or other travel services or resulting directly or indirectly from any occurrences or conditions beyond its control, including, but not limited to acts of god, fire, acts of governments or other authorities, wars, civil disturbances, riots, strikes, epidemics, quarantines, acts of terrorism, defects in vehicles, breakdown in equipment, theft, delay, wildlife, or cancellation of or change in itinerary or schedules.
Weather conditions, including but not limited to the presence or absence of snow, sunshine, and rainfall are not guaranteed to occur or not occur, and are clearly outside of WELTREISE-TRAUM’s control. Volcanic eruptions, ash clouds, and wind may be characterized as an adverse weather condition or a natural disaster by suppliers and your travel insurance company, which is beyond the control of WELTREISE-TRAUM. WELTREISE-TRAUM shall not assume any responsibility for any air and/or ground schedule changes. The additional costs that result from this are at the expense of the customer.
FORCE MAJEURE
“Force Majeure” means, in relation to WELTREISE-TRAUM, any circumstances beyond the reasonable control of WELTREISE-TRAUM, including, but without limitation: acts of God, explosion, flood, tempest, forceful wind, volcano eruption, earthquake, fire or accident, war or threat of war declared or undeclared, acts of terrorism, sabotage, insurrection, riots, strikes, civil disturbance, requisition, sickness, quarantine, government intervention, weather conditions, defects in machinery and vehicles, delay, wildlife, or other untoward occurrences.
WELTREISE-TRAUM shall not be deemed to be in breach of these terms and conditions or otherwise be liable to you, by reason of delay in performance, or by non-performance, of any of its obligations hereunder to the extent that any such delay or non-performance is due to any Force Majeure.
If WELTREISE-TRAUM, and/or any of its travel suppliers, are affected by Force Majeure, they shall be entitled to, and may in their sole and absolute discretion, vary or cancel any itinerary or arrangement in relation to the trip. Payment of any refund by WELTREISE-TRAUM to you as a result of the non-performance of any obligations hereunder shall remain in its sole and absolute discretion, although WELTREISE-TRAUM shall use its reasonable efforts to reimburse you where possible. However, WELTREISE-TRAUM shall be entitled to deduct from any refund recoverable the reasonable actual and potential costs to WELTREISE-TRAUM of the Force Majeure and applicable cancellation fees.
Regarding civil unrest, once WELTREISE-TRAUM has investigated the prevailing situation, as it deems fit, it shall remain in WELTREISE-TRAUM’s sole and absolute discretion whether to proceed with the trip. If, after having made all reasonable and proper inquiries, WELTREISE-TRAUM is of the opinion that the trip may proceed, no refund will be payable to you. You may in such circumstances cancel the trip subject to WELTREISE-TRAUM’s and each supplier’s terms and conditions.
RISKS AND SAFETY
Travel to certain destinations may involve greater risk than others. WELTREISE-TRAUM urges Customers to remain informed on a daily basis as to current news, as well as to review travel prohibitions, warnings, announcements and advisories issued by their country prior to booking travel to international destinations.
WELTREISE-TRAUM draws your attention to the fact that there are certain inherent risks in traveling to undeveloped areas of the world, where wildlife is prevalent, and safari camps are by their nature remote. Your participation constitutes acceptance at your own risk, which includes, but is not limited to, risks of whitewater rafting, kayaking and rafting (for example dangers of rapidly moving water, rocks and other submerged objects and hypothermia), elephant or horseback riding (for example, unpredictable behavior by the elephants and horses), hiking, walking safaris, downhill or cross-country skiing (for example, equipment failures, ice, or other trail obstructions) and in all trips there are also the ever present dangers of undomesticated and wild animals, inaccessibility to medical attention, and difficulty in evacuation from remote locations in the case of a medical emergency. Customer assumes all such risks with regard to these possibilities.
By offering for sale travel to particular destinations, WELTREISE-TRAUM does not represent or warrant that travel to such points is advisable or without risk, and shall not be liable for costs, damages, or losses that may result from travel to such destinations. Customer’s participation constitutes acceptance of such events as customer’s own risk.
HEALTH/SECURITY/TRAVEL DOCUMENTATION REQUIREMENTS
Each Customer is responsible to make absolutely certain to have the proper immunizations and required documentation of such immunizations before travel, and to make the necessary accommodation for security rules imposed by government authorities. Malaria is endemic to regions of Africa, India, and some locations in South America, and precautions must be taken. WELTREISE-TRAUM shall not assume responsibility for the accuracy of health requirements or vaccination and/or documentation prior to departure or upon landing at the final destination. Health matters, including but not limited to concerns related to Norovirus, should be addressed to your personal physician. Customers traveling to areas where vaccination(s) are required are responsible to check medical requirements for wherever you may venture. See your health practitioner for advice. Prior to travel, required inoculations, if any, must be recorded by Customer’s health practitioner on a valid vaccination certificate, which the Customer must carry for proof of inoculation where required. If you are concerned about taking any medications or receiving certain inoculations, check with your health practitioner BEFORE booking, making deposits, and/or non-refundable payments. (Required or advised inoculations you decide to obtain upon the advice of your personal physician may need to be administered in a series of doses months ahead of your planned departure, and such time element should be taken into account by you BEFORE making deposits and/or nonrefundable final payments.)
WELTREISE-TRAUM neither controls nor warrants the issuance of visas related to applicable travel. Should a visa not be issued, WELTREISE-TRAUM is not responsible for lost payments made toward the contemplated trip.
It is your sole responsibility to seek and take all appropriate medical advice relevant to your health prior to departure as to whether or not you are fit enough to undertake the trip booked. WELTREISE-TRAUM shall not be liable for illness, injury or death sustained on a program sold by WELTREISE-TRAUM, which is not due to the gross negligence of WELTREISE-TRAUM, its officers and employees.
LIMITATION OF LIABILITY
By making a reservation, customer acknowledges that in all events WELTREISE-TRAUM shall not be liable for any incidental or consequential damages and that the sole extent of WELTREISE-TRAUM’s liability, if any, shall never exceed the amount actually paid by customer to WELTREISE-TRAUM .
These Terms and Conditions of Sale are subject to change at any time at WELTREISE-TRAUM ’s sole discretion without notice. Any dispute arising out of any vacations offered shall be subject to the exclusive jurisdiction of the German courts.
GENERAL
If any part of these Terms and Conditions is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and agreement shall continue in effect.
These Terms and Conditions (and any other terms and conditions referenced herein) constitute the entire agreement between the Customer and WELTREISE-TRAUM with respect to travel bookings made with WELTREISE-TRAUM by any means accessing such information, including its Web site, and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between Customer and WELTREISE-TRAUM with respect to communications with WELTREISE-TRAUM, including the WELTREISE-TRAUM Web site. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to these Terms and Conditions to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.
In case of doubt, the German version of the Terms and Conditions (AGBs) takes precedence.
